La aceptación digital mediante:

3. Descripción de los Servicios

La Compañía ofrece servicios que incluyen, entre otros:

• Generación de leads

• Sistemas de adquisición de clientes

• Creación de funnels, páginas y automatizaciones

• Implementación del CRM GAP CONNECT

• Sistemas de inteligencia artificial conversacional

• Gestión y configuración de campañas publicitarias

• Estrategias de marketing digital

• Seguimiento y automatización comercial

Los servicios pueden ser entregados de forma inmediata, progresiva o continua según el plan contratado.

4. Naturaleza del Servicio

Los servicios ofrecidos son de carácter digital, estratégico y tecnológico.

La Compañía no garantiza resultados específicos, incluyendo pero no limitado a:

• Ventas

• Ingresos

• Número de leads

• Retorno de inversión

• Conversión de prospectos

Los resultados dependen de factores fuera del control de la Compañía, incluyendo la ejecución del Cliente.

5. Responsabilidad del Cliente

El Cliente se compromete a:

• Atender los leads generados

• Asistir a las citas agendadas

• Utilizar activamente GAP CONNECT

• Dar seguimiento a los prospectos

• Mantener la inversión publicitaria acordada

• Implementar las recomendaciones estratégicas

• Cumplir con todas las leyes aplicables

El incumplimiento de estas responsabilidades afecta directamente los resultados y elimina cualquier garantía aplicable.

6. Pagos y Facturación

Todos los servicios se pagan por adelantado.

El Cliente acepta que:

• Los pagos son obligatorios

• Los pagos son finales

• No existen devoluciones, salvo lo establecido en la garantía

Los planes mensuales se cobran de forma recurrente hasta su cancelación.

7. Política de Cancelación

El Cliente puede cancelar la renovación del servicio en cualquier momento.

Sin embargo:

• La cancelación no genera reembolso

• El servicio continúa hasta el final del periodo pagado

• No se devuelven montos ya cobrados bajo ninguna circunstancia

8. Política de No Reembolsos

Todos los pagos realizados a 3Grow LLC son finales y no reembolsables.

No se otorgarán devoluciones por:

• Falta de uso del servicio

• Cambio de decisión

• Expectativas no cumplidas

• Resultados no obtenidos

• Falta de seguimiento del Cliente

• Desconocimiento de los términos

• Cancelación posterior al pago

9. Garantía Condicional

Como única excepción, la Compañía ofrece una garantía limitada:

Si el sistema no genera al menos el doble de la inversión inicial dentro de un periodo de 60 días, la Compañía trabajará con el Cliente hasta lograrlo o devolverá el monto correspondiente al setup inicial.

Condiciones obligatorias:

El Cliente deberá:

• Atender todas las citas

• Utilizar GAP CONNECT activamente

• Realizar seguimiento continuo

• Mantener la inversión publicitaria

• No modificar el sistema implementado

• Seguir todas las recomendaciones

El incumplimiento de cualquiera de estas condiciones invalida la garantía.

10. Evidencia de Entrega del Servicio

El Cliente reconoce que la Compañía podrá utilizar como evidencia válida de cumplimiento:

• Accesos a la plataforma GAP CONNECT

• Registros de inicio de sesión

• Actividad dentro del CRM

• Automatizaciones configuradas

• Funnels y páginas entregadas

• Comunicaciones realizadas

• Grabaciones de sesiones

• Historial de soporte

• Reportes y dashboards

Estos elementos constituyen prueba suficiente de prestación del servicio.

11. Confidencialidad

El Cliente reconoce que toda la información, sistemas, estrategias, automatizaciones, funnels, procesos, metodologías y tecnología de 3Grow LLC son confidenciales.

El Cliente se compromete a no:

• Copiar

• Compartir

• Revender

• Replicar

• Distribuir

• Utilizar para competir

Esta obligación permanece vigente incluso después de finalizar la relación comercial.

12. Propiedad Intelectual

Todos los sistemas, procesos y materiales pertenecen exclusivamente a 3Grow LLC.

El Cliente recibe únicamente una licencia de uso limitada, no transferible y revocable.

13. Limitación de Responsabilidad

La Compañía no será responsable por:

• Pérdidas económicas

• Fallas de terceros

• Resultados comerciales

• Problemas de plataformas externas

La responsabilidad máxima se limita al monto pagado en los últimos 30 días.

14. Obligación de Contacto Previo

El Cliente acepta que antes de iniciar cualquier disputa deberá contactar a:

Se establece un plazo mínimo de 7 días hábiles para resolución.

15. Prohibición de Contracargos Abusivos

El Cliente acepta no iniciar disputas fraudulentas o abusivas.

Iniciar un contracargo sin fundamento será considerado:

Incumplimiento contractual y posible fraude financiero

16. Acciones en Caso de Disputa

Si el Cliente inicia una disputa, la Compañía podrá:

• Suspender accesos

• Cancelar servicios

• Revocar activos

• Presentar evidencia al banco

• Iniciar procesos de recuperación

17. Costos de Disputa

El Cliente será responsable de:

• Tarifas de disputa

• Costos administrativos

• Honorarios legales

18. Autorización de Cargos

El Cliente autoriza expresamente:

• Cargos completos

• Cargos recurrentes

• Cargos adicionales por uso

Esta autorización sirve como evidencia ante entidades financieras.

19. Renuncia a Reclamaciones

El Cliente renuncia a reclamar desconocimiento del servicio o falta de entrega sin evidencia válida.

20. Suspensión del Servicio

La Compañía podrá suspender el servicio si:

• Existe falta de pago

• Uso indebido

• Actividad fraudulenta

21. Ley Aplicable

Estos Términos se rigen por las leyes del Estado de Florida, Estados Unidos.

23. Términos de SMS y Mensajería Móvil

Pueden aplicar cargos por mensajes y datos. Tu operador móvil puede cobrarte de acuerdo con tu plan telefónico.

24. Instrucciones para Cancelar la Suscripción

• Consulting, training, and support related to marketing, automation, and client acquisition

Services may be delivered immediately, progressively, or continuously depending on the plan purchased.


4. Nature of the Service

The services offered by the Company are digital, strategic, technological, and marketing-related in nature.

The Company does not guarantee specific results, including but not limited to:

• Sales
• Revenue
• Number of leads
• Return on investment
• Conversion of prospects
• Business growth
• Customer acquisition volume

Results depend on factors outside the Company’s control, including the Client’s execution, market conditions, advertising budget, follow-up, offer quality, sales process, industry, and other external variables.


5. Client Responsibility

The Client agrees to:

• Respond to generated leads
• Attend scheduled appointments
• Actively use GAP CONNECT
• Follow up with prospects
• Maintain the agreed advertising investment
• Implement strategic recommendations
• Provide accurate business information
• Maintain updated contact and billing information
• Comply with all applicable laws and regulations
• Use all communication tools, including SMS and email, responsibly and lawfully

Failure to comply with these responsibilities directly affects results and invalidates any applicable guarantee.


6. Payments and Billing

All services are paid in advance.

The Client agrees that:

• Payments are mandatory
• Payments are final
• No refunds are issued except as expressly stated in the conditional guarantee
• Monthly plans are billed on a recurring basis until canceled
• Setup fees, service fees, software fees, implementation fees, and consulting fees are non-refundable

The Client authorizes the Company and its payment processors to charge the payment method provided for all agreed fees, recurring subscriptions, upgrades, additional services, or usage-based charges.


7. Cancellation Policy

The Client may cancel the renewal of a recurring service at any time by contacting the Company through the official support channel.

However:

• Cancellation does not generate a refund
• The service continues until the end of the paid billing period
• Amounts already charged are not refunded under any circumstance
• Cancellation does not eliminate outstanding payment obligations
• The Client is responsible for canceling before the next billing cycle


8. No Refund Policy

All payments made to 3Grow LLC are final and non-refundable.

Refunds will not be granted for:

• Lack of use of the service
• Change of mind
• Unmet expectations
• Results not obtained
• Failure to follow up with leads
• Failure to attend appointments
• Failure to use GAP CONNECT
• Failure to implement recommendations
• Lack of understanding of the terms
• Cancellation after payment
• Disagreement with the business model after purchase
• Technical issues caused by third-party platforms outside the Company’s control


9. Conditional Guarantee

As the only exception, the Company may offer a limited conditional guarantee when expressly included in the Client’s purchase agreement, checkout page, proposal, or offer terms.

If the system does not generate at least double the initial investment within a period of 60 days, the Company may continue working with the Client until the agreed objective is achieved or refund the corresponding initial setup amount, subject to the conditions below.

Mandatory conditions:

The Client must:

• Attend all scheduled appointments
• Actively use GAP CONNECT
• Follow up continuously with leads and prospects
• Maintain the agreed advertising investment
• Avoid modifying or disrupting the implemented system
• Follow all strategic recommendations
• Provide timely feedback and requested information
• Keep all required accounts, integrations, and platforms active
• Maintain professional and consistent communication with prospects

Failure to comply with any of these conditions invalidates the guarantee.

The guarantee does not apply if the Client fails to execute, fails to respond to leads, cancels services, pauses advertising, changes the implemented system, refuses to follow recommendations, or does not provide the necessary cooperation.


10. Evidence of Service Delivery

The Client acknowledges that the Company may use the following as valid evidence of service delivery and compliance:

• GAP CONNECT platform access
• Login records
• CRM activity
• Configured automations
• Delivered funnels and pages
• Campaign setup records
• Communications sent
• Call recordings
• Session recordings
• Support history
• Reports and dashboards
• Email, SMS, WhatsApp, and phone communication logs
• Screenshots, system records, and internal documentation

These elements constitute sufficient proof that the service was provided.


11. SMS Terms and Mobile Messaging Program

By providing your phone number, submitting a form, scheduling a consultation, requesting information, making a purchase, registering for a service, or otherwise opting in through our website, landing pages, ads, forms, checkout pages, calendar pages, CRM forms, or other digital channels, you consent to receive SMS text messages, WhatsApp messages, phone calls, emails, and other electronic communications from 3Grow LLC / GAP CONNECT.

These communications may include, but are not limited to:

• Appointment confirmations and reminders
• Follow-up messages related to your inquiry
• Customer support and service-related messages
• Account, billing, or service notifications
• Marketing, promotional, and educational messages
• Updates about GAP CONNECT services

Messages may be sent using automated technology, including autodialers, artificial intelligence systems, prerecorded messages, automated messaging platforms, CRM systems, and other communication tools.

Message frequency may vary depending on your interaction with us, your requests, your account activity, your scheduled appointments, your purchases, your subscription status, or the services you have inquired about or purchased.

Message and data rates may apply. Your mobile carrier may charge you according to your mobile plan.

Consent to receive SMS text messages, marketing messages, or automated communications is not required as a condition of purchasing any goods or services from 3Grow LLC / GAP CONNECT.


12. SMS Opt-Out Instructions

You may opt out of receiving SMS text messages from us at any time by replying STOP to any text message you receive from us.

After texting STOP, you may receive one final confirmation message confirming that you have been unsubscribed. After this, you will no longer receive SMS text messages from us unless you opt in again.

13. Message and Data Rates Disclosure

3Grow LLC / GAP CONNECT is not responsible for any message or data charges incurred by you as a result of participating in our SMS or mobile messaging program.


14. Carrier Liability Disclaimer

Wireless carriers are not liable for delayed or undelivered messages.

Delivery of SMS messages is subject to effective transmission from your mobile carrier, network operator, and third-party messaging providers.

3Grow LLC / GAP CONNECT is not responsible for delays, delivery failures, message filtering, blocked messages, network errors, carrier outages, third-party messaging failures, or any other issues caused by mobile carriers, wireless networks, third-party providers, or factors outside of our control.


15. Age Restriction

You must be at least 18 years old to use our website, services, CRM tools, marketing systems, forms, consultations, checkout pages, mobile messaging programs, and any services offered by 3Grow LLC / GAP CONNECT.

By using our services, submitting your information, opting in to receive communications, scheduling a call, or purchasing from 3Grow LLC / GAP CONNECT, you confirm that you are at least 18 years of age.

We do not knowingly collect personal information from individuals under 18 years old. If we become aware that we have collected information from a person under 18, we may delete such information and terminate access to our services.


16. Privacy and Communications

The Client acknowledges that all information, systems, strategies, automations, funnels, processes, methodologies, templates, training materials, CRM configurations, artificial intelligence prompts, workflows, and technology provided by 3Grow LLC are confidential.

The Client agrees not to:

• Copy
• Share
• Resell
• Replicate
• Distribute
• Modify for resale
• Use to compete
• Transfer access to third parties
• Reverse engineer any system or process

This obligation remains in effect even after the business relationship ends.


18. Intellectual Property

All systems, processes, materials, strategies, automations, funnels, pages, templates, CRM configurations, training materials, documents, videos, designs, software setups, workflows, and proprietary methods belong exclusively to 3Grow LLC.

The Client receives only a limited, non-transferable, revocable license to use the materials and systems for their own business during the active service period.

The Client may not reproduce, resell, license, distribute, or commercially exploit any Company materials without written authorization.


19. Limitation of Liability

The Company shall not be liable for:

• Economic losses
• Lost profits
• Business interruption
• Third-party failures
• Advertising platform issues
• CRM or software platform failures
• Payment processor issues
• Internet, hosting, or technical failures
• Business results
• Lead quality beyond the Company’s reasonable control
• Problems caused by external platforms
• Decisions made by the Client based on strategic recommendations

The Company’s maximum liability is limited to the amount paid by the Client during the last 30 days.

In no event shall the Company be liable for indirect, incidental, consequential, punitive, or special damages.


20. Prior Contact Obligation

Before initiating any dispute, chargeback, complaint, legal claim, or payment reversal, the Client agrees to contact the Company first at:

A minimum period of 7 business days is established for review and resolution.

Failure to contact the Company before initiating a dispute may be considered a breach of these Terms.


21. Prohibition of Abusive Chargebacks

The Client agrees not to initiate fraudulent, abusive, or unfounded disputes or chargebacks.

Initiating a chargeback without valid grounds, after receiving access to the service, after using the platform, or without first contacting the Company, may be considered:

• Breach of contract
• Financial misconduct
• Fraudulent activity
• Abuse of the payment dispute process

The Company reserves the right to present evidence to banks, payment processors, financing providers, and legal authorities.


22. Actions in Case of Dispute

If the Client initiates a dispute, chargeback, or payment reversal, the Company may:

• Suspend access
• Cancel services
• Revoke access to assets
• Disable CRM, funnels, automations, and systems
• Present evidence to the bank or payment processor
• Initiate collection or recovery procedures
• Report misuse of services or fraudulent activity
• Terminate any active agreement with the Client


23. Dispute Costs

The Client may be responsible for:

• Dispute fees
• Administrative costs
• Collection costs
• Legal fees
• Recovery fees
• Costs associated with preparing and submitting evidence

This applies when a dispute, chargeback, or payment reversal is found to be abusive, unfounded, or in violation of these Terms.


24. Authorization of Charges

The Client expressly authorizes:

• Full charges
• Recurring charges
• Setup fees
• Monthly fees
• Additional service charges
• Usage-based charges
• Upgrade charges
• Add-on charges

This authorization serves as evidence before banks, payment processors, financing companies, and financial institutions.

The Client agrees that charges made in accordance with the selected service, subscription, or agreement are valid and authorized.


25. Waiver of Claims

The Client waives the right to claim lack of knowledge of the service, lack of delivery, or lack of authorization when evidence shows that the Client:

• Submitted a form
• Scheduled a call
• Made a payment
• Accessed the platform
• Received services
• Communicated with the Company
• Used GAP CONNECT
• Received funnels, automations, reports, or support
• Accepted these Terms digitally


26. Suspension of Service

The Company may suspend or terminate the service if:

• There is non-payment
• There is misuse of the platform
• There is abusive behavior
• There is fraudulent activity
• The Client violates these Terms
• The Client initiates an unfounded dispute
• The Client misuses SMS, email, CRM, or automation tools
• The Client violates applicable laws or third-party platform rules

Suspension does not entitle the Client to a refund.


27. Third-Party Platforms

The Company may use third-party platforms, including but not limited to CRM systems, advertising platforms, payment processors, messaging providers, hosting services, email providers, SMS providers, artificial intelligence tools, and analytics platforms.

The Company is not responsible for service interruptions, policy changes, account suspensions, delays, errors, or failures caused by third-party platforms.

The Client agrees to comply with the terms, policies, and requirements of any third-party platforms used in connection with the services.


28. Compliance With Laws

The Client is responsible for complying with all applicable laws, rules, and regulations related to their business, marketing, advertising, communications, data privacy, SMS messaging, email marketing, and customer interactions.

The Client agrees not to use GAP CONNECT or any Company-provided system for illegal, deceptive, abusive, discriminatory, or unauthorized communications.


29. Governing Law

These Terms are governed by the laws of the State of Florida, United States.

Any dispute shall be handled in accordance with the laws of the State of Florida, unless otherwise required by applicable law.

FINAL DECLARATION

The Client acknowledges that they have read, understood, and accepted these Terms and Conditions in full, including the no-refund policy, anti-dispute provisions, SMS and mobile messaging terms, opt-out instructions, age restriction, message and data rate disclosures, and carrier liability disclaimer.

The Client agrees that any unfounded chargeback, unauthorized misuse of services, or violation of these Terms may be treated as a breach of contract.

By using this website, submitting information, scheduling a call, purchasing a service, opting in to receive communications, or using GAP CONNECT services, the Client confirms acceptance of these Terms and Conditions.
